Criticism from the Republicans about Operation Allies Refuge and Operation Allies Welcome is nothing new. How the U.S. handled leaving Afghanistan has caused an uproar from the right since 2021, but now, things are getting a bit more serious. Donald Trump is gearing up for a second presidential term and this time around, he’s preparing a list of people to court-martial with a connection to the removal of American troops from Afghanistan years ago.

Trump Planning to Court-Martial Leadership Connected to Afghanistan Withdrawal

It doesn’t matter if you’re still a senior officer or previously served as one, if you were involved with exiting Afghanistan in 2021, Donald Trump and his administration want to review your decisions.

The core focus of Trump’s team is to review the officers who were directly involved in making decisions during the withdrawal and whether or not they should be court-martialed.

Moving into more serious notions, not only is the decision-making of officers being looked at but the steps taken during the operations are also being scrutinized—charges may vary but even treason is on the table here.

Some experts believe that the review is going to take into consideration how troops ended up in Afghanistan in the first place and compare it with why Americans left.

Critics who know Trump’s team, though official responses seem limited if not non-existent as of this writing, have pushed back saying that the story of the court-martials is Washington politics at its finest rather than a genuine plan.

Why There’s a Potential for Court-Martials

Many Republicans on the House Foreign Affairs Committee created a report about the evacuation of Afghanistan claiming the following:

  • Instead of safety, the Biden administration chose optics and was going to leave with or without the Doha Agreement.
  • The lack of planning created the hostile conditions that unfolded when the U.S. was trying to leave.
  • In addition to failing to plan, the Biden administration misled Americans about every stage of the operations.
  • Finally, al Qaeda and ISIS-K benefited from the withdrawal because there was no plan in place when American troops left.

Sadly, 13 American service members and over 100 Afghans trying to evacuate were killed following a chaotic incident in Kabul which included a suicide bomber.

The report was used by Trump during his campaign in some of the final months and weeks leading up to Election Day.

Trump Administration Sees the Withdrawal From Afghanistan as Humiliating

While the GOP on the House Foreign Affairs Committee may embrace the report on Biden’s withdrawal, Democrats unsurprisingly have distanced themselves and disagree.

Both Donald Trump and his pick for Secretary of Defense Pete Hegseth have echoed sentiments that the withdrawal was humiliating.

It’s still unsure whether or not charges related to treason would be pursued but it’s not completely impossible to assume they wouldn’t be a part of the discussion either.

At the heart of the matter is one side believes they tried to get troops home while the other disagrees with the methods used to do so.

Because things got messy and so many people lost their lives, in addition to terrorism growing in influence throughout the region, court-martials have come into play to address the perceived lack of accountability from military leaders and the government.

Interestingly enough, the Trump administration is also believed to be considering bringing back military leaders who were a part of the withdrawal for active duty so that they too can face court-martials.

Interestingly enough, this is not unprecedented, as retired military Veterans have been court-martialed before, as permitted by the Uniform Code of Military Justice (UCMJ).

Despite Biden and leadership believing a secure exit was possible, conditions deteriorated toward the end, fostering an environment for the chaos that would come to be.

Whether or not these actions and decisions by senior officers are enough for a court-martial may be the debate of JAG soon enough if Trump and his administration continue with their alleged plan.
